Terms of Use – Bizwin New Zealand

1. Agreement to Terms

By accessing or using Bizwin’s services (“the Service”), including our website, business profiles, job listings, and property listings, you agree to these Terms of Use (“Terms”). If you disagree with any part of these Terms, please do not use our Service.

2. Changes to Terms

We may modify these Terms at any time at our discretion. Changes become effective immediately upon posting. Your continued use of the Service following any changes indicates your acceptance of such changes.

3. Service Description

Bizwin provides an online platform connecting businesses, professionals, and consumers. While we strive to maintain high standards, we do not verify all user-submitted information. The Service is provided “as is” and “as available.”

4. User Content and Conduct

4.1 Content Responsibility

You are responsible for all content you post, submit, or display through the Service (“Content”). By posting Content, you:

  • Warrant that you have the right to post such Content
  • Grant Bizwin a worldwide, non-exclusive, royalty-free license to use, modify, and distribute your Content
  • Accept responsibility for its accuracy and legality

4.2 Prohibited Content

You must not post Content that:

  • Is unlawful, harmful, threatening, or abusive
  • Is discriminatory or promotes discrimination
  • Infringes on intellectual property rights
  • Contains false or misleading information
  • Contains spam or unauthorized commercial content
  • Violates any applicable New Zealand law

5. Intellectual Property Rights

  • The Service is protected by copyright and other intellectual property laws
  • Our trademarks and branding may not be used without written permission
  • You retain ownership of your Content, but grant us necessary licenses to operate the Service

  • All fees are in New Zealand dollars and include GST
  • Fees are non-refundable unless required by New Zealand Consumer Law

  • You must maintain valid payment information

  • We may suspend or terminate accounts for Terms violations
  • Termination may be immediate for serious breaches

9. Liability and Disclaimers

9.1 Disclaimer of Warranties

To the maximum extent permitted by law, we provide the Service “as is” without any warranties of any kind.

9.2 Limitation of Liability

To the extent permitted by law, Bizwin shall not be liable for any indirect, incidental, special, or consequential damages.

10. Indemnification

You agree to indemnify and hold harmless Bizwin, its officers, directors, employees, and agents from any claims arising from your use of the Service or violation of these Terms.

11. Dispute Resolution

  • Any disputes will be governed by New Zealand law
  • Courts of New Zealand shall have exclusive jurisdiction
  • We encourage attempting to resolve disputes informally before legal action
